Terms & Conditions
The Buyer (Internet user) on the one hand, and the Seller ("OZP" online store - www.ozp.biz) on the other hand, have concluded this agreement as follows:1. General provisions
1.1. This agreement is a public offer and contains all the essential conditions for organizing the sale and purchase remotely (i.e. through the HobbiTorg online store).
1.2. In case of acceptance of the terms of this Agreement, the Internet user, citizen (ka), making a purchase via the Internet, becomes the Buyer. The reason for this will be the fact of 100% payment for the order on the terms of this Agreement.
2. Terms and definitions
2.1. "Online store" - the Seller's website, which contains descriptions, photos, videos and other information about the goods sold.
2.2. "Goods" - all the goods of the Seller placed on the pages of the online store, which, after payment, are delivered by carrier services to the Buyer.
3. Subject of the contract
3.1. The Seller undertakes to transfer the goods to the Buyer, and the Buyer undertakes to pay for and accept the goods on the terms of this Agreement.
3.2. This agreement regulates the process of buying and selling through an online store.
Including: a) voluntary choice by the Buyer of goods in the online store;
b) independent registration by the Buyer of the order in the online store;
c) payment by the Buyer of the order placed in the online store;
d) execution and transfer of the order to the Buyer in ownership on the terms of this Agreement.
4. How to place an order
4.1. The buyer independently places an order in the online store.
4.2. The buyer is responsible for the choice and quantity of goods on their own.
4.3. The buyer is responsible for the correct indication of personal data when placing an order.
5. Cost and order payment procedure
5.1. The total cost of the order consists of the cost of the goods in the online store, the cost of delivery and / or packaging (tare), bank interest (if any).
5.2. The cost of delivery in the online store depends on the current tariffs of the delivery organization or company.
5.3. The buyer pays for the order in any way selected in the online store within three working days from the date of placing the order in the amount of 100% prepayment.
5.4. When paying by cash on delivery, the Buyer pays for the delivery of the amount for the goods by the transport company that transported the goods to him.
6. Order delivery
6.1. The total delivery time of goods from the warehouse consists of the order processing time and the delivery time. Order processing time up to 5 (five) business days. Delivery time by a specialized organization is indicated in the online store approximately and depends on the chosen delivery method and the efficiency of the delivery services.
7. Procedure for returning or exchanging goods
7.1. The exchange and return of goods takes place by agreement with the Buyer, in accordance with the current Law "On the Protection of Consumer Rights".
Return and exchange of goods is possible within 14 days after receipt of the goods by the buyer.
7.2. To return the goods purchased in the "OZP" online store, you must provide documents confirming the fact of purchasing the goods in printed or electronic form.
7.3. In case of return of goods of inadequate quality (manufacturing defect), the return is made at the expense of the store (the cost of shipping the goods from the Buyer to the store). After the defect is confirmed by the technical specialists of the store, the product is replaced with an identical or equivalent product, as agreed with the Buyer, or the cost of the product is returned to the Buyer.
7.4. In case of return of goods of good quality, for other reasons (did not like it, did not fit in size, shape, characteristics, color, etc.) within the period established by the Law "On Protection of Consumer Rights", the return is made at the expense of the Buyer (the cost of delivery of goods from the Buyer to the store). After checking the quality of the goods by the technical specialists of the store (the safety of the packaging, the complete set, the absence of traces of operation, the presence of factory seals, serial numbers and other information media provided by the manufacturer), the goods are replaced with an identical or equivalent product, as agreed with the Buyer, or a refund goods to the Buyer, minus the associated fees that may have arisen upon payment / refund of payment.
7.5. Refunds will be made by bank transfer within 7 business days from the date we receive the item.
7.6. According to the Consumer Protection Law, a company may refuse to exchange or return goods of good quality to a consumer if they fall into the categories specified in the current "List of non-food goods of good quality that are not subject to return and exchange".
8. Rights and obligations of the parties
8.1. Buyer must:
a) accurately indicate information about yourself: full name, phone number, delivery address and other data necessary for concluding a transaction;
b) place an order in the online store;
c) timely pay for the order;
d) accept the goods at the address specified in the order at the specified time or entrust the acceptance of the order to a trusted person. If the order was not accepted at the specified address due to the absence of the Buyer or authorized representative, the transport costs for this trip will be included in the cost of this or subsequent orders;
8.2. The Buyer has the right to require the Seller to comply with the terms of this Agreement.
8.3. The Seller (manager) has the right to edit the Buyer's existing order (delete / add the goods necessary for the Buyer) only by agreement of the parties (with the permission of the Buyer).
8.4. The seller must:
a) comply with the terms of this agreement.
b) transfer the goods to the Buyer in accordance with the selected sample in the online store, the order placed and the terms of this agreement.
c) be fully responsible to the Buyer for the execution of the order until the transfer of the order to the Buyer.
9. Reserve (reserve clause of the agreement)
10. Liability of the parties
10.1. In case of force majeure, the parties are released from the execution of this agreement.
10.2. The Parties shall make every effort to eliminate the arising disagreements exclusively through negotiations. Otherwise, the contract may be terminated.
10.3. The Seller is not responsible and does not reimburse the losses incurred by the Buyer due to improper use of the goods and non-compliance with safety and operation regulations.
10.4. The Seller is not responsible and does not reimburse the losses incurred by the Buyer due to incorrect filling of personal data (Last Name, First Name, Patronymic) and the place of delivery (city, warehouse) when ordering delivery by Nova Poshta. When ordering by Ukrposhta, the Buyer is obliged to correctly indicate the full address, including the postal code.
10.5. The Seller is not liable, cannot act as a defendant in court and does not compensate for losses incurred by the Buyer due to the action or inaction of third parties or organizations.
10.6. The Seller reserves the right to refuse to serve the Buyer if the customer's order has not yet been paid, without giving reasons.
11. Validity of this Agreement
11.1. This agreement is an agreement of accession and comes into force from the moment the Buyer accedes to this agreement and accepts its terms by checking the box “I agree with the terms of the Agreement” and is valid until the Buyer and the OZP online store fully fulfill their obligations under the above agreement.
